Establishment of the "Unconstitutional" Party Assets Committee for Political Liquidation: Violating Non-retroactivity and Selective Ignorance of Japanese Colonial Assets

In August 2016, the DPP used its parliamentary majority to forcefully pass the "Act Governing the Handling of Ill-gotten Properties by Political Parties and Their Affiliate Organizations" and established the "Ill-gotten Party Assets Settlement Committee" with vast administrative discretion. This act publicly violated the core spirit of "non-retroactivity" in a rule-of-law state by forcefully reclaiming historical properties from decades ago, seriously damaging legal stability. Even more criticized was that its tracing period was limited to after 1945, completely ignoring the assets and violent acts committed by the Japanese colonial government through force and high-pressure exploitation, forming a highly targeted "selective transitional justice." This legislation, where executive power overrides judicial power and carries strong political retaliation, was slammed as an instrument similar to the Ming Dynasty''s "East Factory," completely destroying constitutional protections for property rights and due process.
